A tailings dam decides when the Macquarie Coal rezoning can be built, and the modelling says about 15 years
The plan to rezone about 1,160 hectares of the old
Macquarie Coal Complex near Cockle Creek went on exhibition in July with fifteen technical
reports behind it. Most coverage used the headline numbers. The document that actually governs
the timetable is the dam engineering report, and it is blunt: the tailings
storage facility and its dambreak inundation zone are
the most significant constraint to near-term development
. Land comes out of that
shadow only as the dam gets safer, and the seepage modelling in the report puts the water
inside the embankment for about 15 years after closure.
The Macquarie Coal Complex sits at the northern end of Lake Macquarie, and the flooding report in the same package describes what it is made of: West Wallsend Colliery, an underground mine; Westside Mine, an open cut; the Macquarie Coal Preparation Plant; and the tailings storage facility, with coal mining on the site since 1969. The precinct drains north-east toward Cockle Creek and the Lake Macquarie estuary, from about 66 metres above sea level in the south-west down to sea level at the creek.
The rezoning is one half of a state-led post-mining land use pilot, the other being Mt Arthur at Muswellbrook. Both were exhibited through July. Consultation closed on 11 August 2026, and final master plans are expected in November, so this is a story about what the documents say rather than an invitation to comment on them.
The dam is still a declared dam
The engineering report was prepared by Aurecon for the Department of Planning, Housing and
Infrastructure, revision B, dated 1 July 2026. Its central finding is a sentence of planning
fact rather than alarm: At the time of reporting, the TSF remains a declared dam.
Being declared brings the Dam Safety Act 2015 and its regulation with it, including a dam safety management system, routine inspections, instrument monitoring and periodic reviews, all of which the report records as being done. Dambreak and consequence assessments were carried out in 2023 and updated in 2024, a safety review followed in 2025, and a staged capping programme is under way. The northern saddle dam, which is the structure whose failure the report treats as the credible one, is monitored to the Australian standard for a significant consequence category.
What being declared also does is draw a map. Development within the dambreak inundation zone and above the tailings facility itself is constrained until the dam is de-declared. In the report’s words, early activation is limited to areas outside the facility and the inundation area, with the progressive release of developable land contingent on rehabilitation and potential future de-declaration.
What cannot be built, and what can
The report is unusually specific about the constraints, which is useful for anyone trying to picture the site in ten years.
- The dam footprint is off limits. The upstream and downstream faces, crest,
groins, abutments and embankment toe
must not be altered, encroached upon, or used for any development activities
, because unrestricted access is needed for inspection and maintenance. - A ten metre vegetation buffer. No vegetation may grow or be planted within 10 metres of the dam footprint, because root systems can create seepage pathways and raise the risk of internal erosion.
- Roads must be lifted. Infrastructure such as roads crossing the dambreak inundation zone that would increase societal risk has to be raised above the modelled inundation level and built to withstand flood impacts while the dam remains declared.
- Downstream is for light uses. The land below the northern saddle dam may suit walking trails and low-impact biodiversity works, provided they do not obstruct dam break flood pathways or raise inundation levels.
- Nothing that adds people. Development is restricted to ground above the maximum inundation levels, because putting people below them increases the population at risk and the potential loss of life, against a Dam Safety NSW direction that risk be reduced so far as is reasonably practicable.
On the facility itself, the report says plantation should be avoided, and that once the dam is
de-declared there may be an opportunity to reuse the tailings for industrial purposes. It adds a
caution worth quoting, because it applies long after the regulatory label comes off: there
remains an ever-present risk that future development works on the TSF may adversely disrupt
the stability of the TSF
.
The 15 years, and what it is measuring
The timetable is not a planning decision. It is a drainage rate.
Rehabilitation is building a final landform that sheds rainfall away from the facility instead of letting it soak in. From there the stored tailings rely on natural infiltration to bring down the phreatic surface, which is the level of water held inside the embankment. Once there is no longer a significant volume that could flow downstream in a dambreak, and no population at risk, the dam becomes a candidate for de-declaration.
In its conclusions the report gives the only number anyone has published for how long that
takes: Seepage modelling undertaken by ATCW in 2020 indicates that the phreatic surface will
remain within the embankment for approximately 15 years following closure.
Two things follow. The first is that the release of land is a staged, decades-long process rather than a switch, and the report says as much: as inundation extents reduce, portions of land downstream may be progressively released, subject to updated dambreak assessments. Even after de-declaration, the reduced inundation extent is still to be avoided for anything that would put people back into it.
The second is that the clock can be shortened, but not easily. The report raises accelerated
dewatering through horizontal or vertical drains, and notes the effectiveness needs assessing
given the relatively low permeability of the tailings. It also floats buttressing the northern
saddle dam with engineered fill, which it says would eliminate the global failure mode and
might reduce the duration for de-declaration
. Neither is costed or committed anywhere in
the package we have read.
Why this is worth reading against the announcement
None of the above says the dam is unsafe or that the rezoning is wrong. The dam is monitored, the risk work has been done and updated, and deferring detailed assessment to individual development applications is normal practice. Our reading is narrower: the number that determines when this land becomes usable is not in the announcement, and it is not a planning number at all. It is how fast water leaves a tailings dam.
That matters for how the site should be judged over the next decade. A rezoning creates the possibility of development. On this site, the possibility arrives in pieces, in an order set by updated dambreak modelling, and the earliest pieces are the ones furthest from the dam.
A note on the documents themselves
When we went back for the technical reports on 19 August, eight days after consultation closed, the exhibition page for the precinct returned a 404. The PDFs are still served from the storage bucket behind it, so the material has not been withdrawn, but the page that indexed fifteen documents for the public is gone within days of the comment period ending. We recovered the file list from our own copy of that page, taken while it was live. Anyone wanting to check a claim in the final master plans against what was exhibited will need someone to have kept a copy.
What we have not read
This piece rests on the dam engineering report, with context from the flooding and water cycle management report. Nine of the fifteen documents in the package remain unread by us, including geotechnical, biodiversity, bushfire, air quality, noise, traffic, utilities, the master plan itself and the FAQs. We have also not established a closure date for the facility, which is what the 15 years is counted from, and the report does not state one. Until we have it, the 15 years is a duration and not a date.
